Description:
We would like to run our business as we have for the last ten years. Having music on weekends has been very popular for our local rafting guests and the surrounding neighborhood. Many locals book their trip with the plan to stay afterwards and listen to music. These musical performances are free and open to the public which the local neighborhoods love. We are trying to improve the designated blight zone in this area and the residents applaud those efforts. We would like to have music on Friday 5-10, Saturday 5-10 and Sunday 3-7pm. With 12.77 acres of commercial land it is easy to conform to the noise code.

11. I am the property owner and agree to let Mountain Whitewater and Paddler’s Pub to use the property.

1. Date Submitted: 04/19/2023There will be about 10 employees. Hours of the music is from 5pm-10pm possible but only paying music for 4 hours Monday - Saturday. If for some reason they are not available, the bartender will implement getting help. Ensure that emergency personnel have access to the site at all times. Because the area is fairly small, cell phones will be used to communicate with employees if face to face communication is not possible. The poudre fire authority will be notified of the event.

Comments: As noted on Special Event applications for this site for many years, the way the applicants have "run our business . . .for the last ten years" has been out of compliance with county land use, building and health codes. This is an unapproved use, not a non-conforming use. The house is not approved for any commercial use and is not disabled-accessible and may not be used in any way for the special event or the rafting business. Adequate portapotties and hand-washing stations shall be provided, including at least one of each being an accessible unit. The existing landscape stage may be used. Comments: --As was noted in Health Department comments from 2022, the current residence on the property includes plumbed restrooms but is not approved for use as a commercial structure for access by the public as it has not received building department approval for this use. In addition, the septic system is not properly sized to accommodate commercial wastewater flows. Under a special event permit from the County, the applicant is allowed to utilize portable restrooms for the event. For the proposed 300 people for 8 hours with alcohol service, a minimum of 9-10 portable restrooms would be required with no use of the residence/office restrooms by the public. --At least one of the 9-10 restrooms shall be of accessible/enhanced access design. --A minimum of one hand wash station with soap, paper towels, waste bin, and waste water bucket (if applicable to design) shall be provided for every 5 portable restrooms. For 9-10 portable restrooms, this would require 2 hand washing stations. --Covered trash receptacles shall be provided throughout the event site and at the portable restrooms. --If food will be provided, food vendors must hold a 2023 Colorado Retail Food License or 2023 Larimer County Temporary Food License. Only limited beverage service is allowed as the site does not hold a Retail Food License. Beverages may be served in cans, bottles or dispensed into disposable cups from a keg, bottle, etc. --In previous years of the event, it was noted that the pub planned to offer light snacks. Only commercially prepared, non-potentially hazardous/shelf-stable, individually packaged items (candy bars, chips, pretzels, nuts, jerky, etc) that are shelf-stable (refrigeration not required) may be sold. Patrons may order take out/delivery from other retail food establishments if the owner allows outside food. --The Larimer County Noise Ordinance will apply. A maximum of 55 decibels is allowed from 7am to 7pm at the event site property lines, and a maximum of 50 decibels is allowed from 7pm to 7am at the event site property lines. The event coordinator shall mitigate noise to ensure that decibels do not exceed the limit.Larimer County Emergency Management
