Chair Grazier called the meeting to order at 5:00 p.m.

 

1.   Chair Grazier welcomed new member Neil Snyder.

 

2.   First item was the approval of August 5, 2019 minutes. Member Wise moved to approve the minutes as corrected. The motion was seconded by member Stockley. Chair Grazier asked member Bright if she was comfortable with the corrected minutes. However, the corrections were not made and member Secretary West was absent so the minutes were approved and would be signed once corrected at the next meeting. There was no further discussion. All present were in favor except member Snyder who abstained because he was not present.

 

3.   Chair Grazier suggested we reorder the agenda. Rock Ridge Ranch Rural Land Use Plan, File #19-LAND3932 was moved to the second item on the agenda. All were in favor.

 

4.   Rock Ridge Ranch Rural Land Use Plan, File #19-LAND3932 :  

Rob gave an overview and update of the Rock Ridge Ranch Rural Land Use Plan, following a site visit immediately before the RLUB meeting by members Bright, Snyder, Wise, Stockley, and West. Slides were presented and the owner was present with questions regarding her building rights for a building envelope versus a platted lot. The property is a total of 107 acres, with 55 acres and 52 are a conservation easement. This is a gateway property zoned FA-1 farming with foothill pasture and agricultural land. The proposal is for three new lots with an additional building envelope on 4.5 acres.

 

Member West and Chair Grazier asked to explain the building envelope and where it was on the map. Rob explained it was a 4-acre building envelope on the existing 86 acres. Member West and Chair Grazier discussed the building rights and that owner Block would need to be very specific in her building plans as amendments are unlikely to be accepted. Ditch questions were raised by Chair Grazier and after a detailed discussion, it was decided that it would be handled directly by the applicant who has an existing agreement with the Handy Ditch company.

 

 

Neighborhood meeting minutes were reviewed by Rob and the neighbors had concerns regarding Kewitt site as it was not returned to its original condition. Another concern was HOA road maintenance for any prospective new residents on the building lots. Member Wise said the Kewitt improvements were already approved and would not concern this Board meeting. Member West asked if the drainage test had been done but it has not. Two wells exist and will need to be re-permitted and 2 new wells would be drilled. Applicant Patty Block will farm the land and not sell out to developers which everyone agreed was a better outcome. Chair Grazier and member Wise discussed the road maintenance and the Ellis Ranch HOA. A condition for approval will include a road maintenance agreement.

 

Chair Grazier asked to hear from the applicant who mentioned the power grid split between Loveland and PVREA. Rob said that there are no utility maps at all in Larimer County.


Member Wise asked the applicant to clarify what her intent was exactly: 3 lots with a building envelope on the residual lot or 4 platted lots because the building rights and zoning ordinances would vary.

 

MOTIONS:  Members Snyder and Bright each moved to approve the Rock Ridge Ranch Rural Land Use Plan, File #19-LAND3932 and both motions were eventually withdrawn but not before member Bright motioned to vote on the condition that the 4th lot be physically mapped and delivered to the Board by email virtually and it was voted down.

Discussion:

Member Wise would not vote until a revised map was in hand. All were in favor including the applicant. A second meeting was set for December 16, 2019 to address the Rock Ridge Ranch Rural Land Use Plan, File #19-LAND3932 and to review a new map including the applicant’s 4th lot added. A road maintenance agreement is also a condition to be presented to the Board prior to voting. All were in favor.

 

5.   Land Use Code 2020: Matt Lafferty presented a slide deck to the RLUB about Clarion and shared

the history and evolution of land use codes. The recorder batteries died and Matt’s audio was not recorded. Master Plan has not been updated in 20 years. Following extensive damage from flooding and wildfires, the land use plans for the mountainous and agricultural areas need to be revised in particular to create a new body of land-use regulations for Larimer County. Matt invited members of the Board to attend a public meeting with Clarion on Wednesday, December 4, 2019 1 to 3 pm.

 

Member Snyder motioned to adjourn. Member Bright seconded.
