AGENDA TOPICS:

 

Chair Grazier called the meeting to order at 5:08 p.m.

 

1.   Approval of April 18, 2016 minutes. †Member Wise made a motion to approve the April 18, 2016 minutes. †Seconded by Member Hostetler. †All were in favor.

 

2.   Introduction and Welcome Patti West and Michael Ehler

 

3.   Designation of the official place for posting of agendas for RLUAB meetings:

Member Ehler made a motion to designate the official place for posting the RLUAB agendas to be the County Commissioners Agenda and the Larimer County website in accordance with the requirements of the Colorado Open Meetings laws (CRS 24-6-402).† Member West seconded the motion.† All were in favor.† Motion carried unanimously.

 

4.   Election of Officers

 

Member Carlson made a motion to re-elect present officers.† Member Wise second the motion

Other Business:† Chairman Grazier gave a brief update on the work session with the County Attorney, Commissioner Johnson and Commissioner Gaiter that took place in October regarding the uses allowed on residual lots.† The County Attorney is taking a stance that if uses are not specifically called out in the development agreement then those uses are not allowed.† Chairman Grazierís understanding was that Director Gilbert would write a letter addressing all RLUP projects owners regarding allowed uses on residual and the stance the County Attorney is now taking.† Chairman Grazier also stated that at the work session she questioned if the legislation could be modified. †Commissioner Johnson stated if any changes were to be made to the legislation this would cause problems for other counties using the statue even if it does clarify our issue at hand.†

 

Member Wise stated that the attorney is quoting the State Law which also agrees with Commissioners Steve Johnson legislation.† The residual lots are for ag structures and possible an accessory dwelling to help maintain the ag lot, not a single family lot.

 

Member Carlson feels that that the County Attorney should write the letter. ††He also stated he is unsure at this time what to do and how to educate the property owners on this matter.† Member Carlson went on to say that the letter should not give out options but address the situation where an interpretation was made that may affect what residual lots could be used for and with this information that they want to modify the development agreement depending on what their future plans are.†

 

Member Wise stated at the work session the County Attorney was crystal clear on how they wanted to move forward and it is our responsibility to inform residual lot owners this matter

 

The agreement of this board was that a letter should be mailed out to all residual land owners that a recent interruption was made regarding residual land that may affect you.
