LARIMER COUNTY PLANNING COMMISSION

 Minutes of October 17, 2018

 

The Larimer County Planning Commission met in a regular session on Wednesday, October 17, 2018, at 6:30 p.m. in the Hearing Room.  Commissioners’ Choate, Johnson, Miller and Wallace were present. Commissioner Jensen presided as Chairman.  Commissioners’ Gerrard and Lucas were absent.  County Staff present were Lesli Ellis, Community Development Director, Carol Kuhn, Principal Planner, Rob Helmick, Senior Planner, Eric Fried, Chief Building Official, Clint Jones, Engineering Department, Lea Schneider, Health Department, and Debby Johnson, Recording Secretary. 

 

The Planning Commission had no site visit today.

 

COMMENTS BY THE PUBLIC REGARDING THE COUNTY LAND USE CODE:   None.

 

COMMENTS BY THE PUBLIC REGARDING OTHER RELEVANT LAND USE MATTERS NOT ON THE AGENDA:   None.

 

APPROVAL OF THE MINUTES FOR THE SEPTEMBER 19, 2018 MEETING:

 

MOTION by Commissioner Wallace to approve the minutes, seconded by Commissioner Johnson.  This received unanimous voice approval.

 

AMENDMENTS TO THE AGENDA:  None.

 

REMOVED ITEM:  None.

 

CONSENT ITEMS:

 

ITEM #1 - 2018 BUILDING CODES FILE #18-CODE0230 :   Eric Fried provided background information for the Planning Commission’s recommendation to adopt the 2018 International Residential Code, 2018 International Building Code, 2018 International Plumbing Code, 2018 International Mechanical Code, 2018 International Fuel Gas Code, 2018 International Energy Conservation Code, 2018 International Existing Building Code, and 2018 International Property Maintenance Code, as amended by Larimer County, and to repeal the currently adopted 2015 International Residential Code, 2015 International Building Code, 2015 International Plumbing Code, 2015 International Mechanical Code, 2015 International Fuel Gas Code, 2015 International Energy Conservation Code, 2015 International Existing Building Code and 1997 Uniform Code for the Abatement of Dangerous Buildings, as amended by Larimer County, to be effective January 1, 2019.

 

Commissioner Wallace moved that the Planning Commission adopt the following Resolution:

 

BE IT RESOLVED that the Planning Commission recommends to the Board of County Commissioners approval of the Adoption of the 2018 Building Codes as amended by Larimer County File #18-CODE0230.

Commissioner Choate seconded the Motion.

 

Commissioners’ Choate, Johnson, Miller, Wallace and Chairman Jensen voted in favor of the Motion.

 

MOTION PASSED:  5-0

 

ITEM #2 - CRYSTAL LAKES 12TH LOT 20 SPECIAL EXCEPTION - FILE#17-ZONE2257:   Rob Helmick provided background information on the request for A) Special Exception for a short-term rental of a single-family dwelling in the E- Estate zoning district.  B) Appeal to Larimer County Land Use Code Section 8.1.4.G.1 Standards for Non-residential Development Outside of a GMA – Water Supply.  C) Appeal to Larimer County Land Use Code Section 8.6.3 Access/Parking standards.

 

DISCUSSION:

 

Dennis Belt, next door neighbor, stated his confusion about the consent agenda and would like to speak.

 

Chairman Jensen stated that this is a consent item and normally we don’t allow public comment at this time but would let Mr. Belt speak briefly.

 

Mr. Belt stated his concerns regarding noise with the short-term rental and possible fire with the camp fire pit threat.

 

Commissioner Wallace reviewed the regulations concerning consent items on the agenda.

 

Chairman Jensen stated that the applicant and property owner, Michael and Kandy Jensen, are of no relation.

 

Commissioner Wallace moved that the Planning Commission adopt the following Resolution:

BE IT RESOLVED that the Planning Commission recommends to the Board of County Commissioners approval of the Crystal Lakes 12th Lot 20 Special Exception and approval of the Crystal Lakes Lot 20 appeal to Land Use Code Section 8.1.4.G.1 Standards for Non-residential Development Outside of a GMA – Water Supply to waive requirement for sprinkler system, File #17-ZONE2257, for the property described on “Exhibit A” to the minutes, subject to the following conditions:

 

A.   Special Exception:

 

The Development Services Team recommends Approval of the Crystal Lakes 12th Lot 20 Special Exception file #17-ZONE 2257 subject to the following condition(s):

1.   The applicant shall submit a residential alteration permit for a change of use prior to commencement of the vacation rental use.

2.   The vacation rental use is limited to no more than one living unit of no more than 6   adults.

3.   Prior to the submittal of a change of residential alteration permit for a change of        use, the applicant shall provide evidence of adequate water supply to address the   State Engineer’s Office requirements.

4.   Prior to the issuance of the issuance of a residential alteration permit for a change of             use, the applicant shall pay any additional Transportation Capital Expansion Fees                      (TCEF).

5.   Failure to comply with any conditions of the Special Exception approval may result in reconsideration of the use and possible revocation of the approval by the Board of Commissioners.

6.   No parking associated with the short term rental on Mic Mac Dr. is allowed.

 

B: Appeals:

The Development Services Team recommends approval of the Crystal Lakes Lot 20 appeal to Land Use Code Section 8.1.4.G.1 Standards for Non-residential Development Outside of a GMA – Water Supply to waive requirement for sprinkler system, subject to the following four (5) conditions:

Provided the following alternatives are implemented prior to the final inspection of a residential alteration permit for a change of use:

·  The applicant shall install a stove top fire suppression system.

·  The applicant shall install fire extinguishers in all sleeping rooms.

·  The applicant shall prepare and have maintained a user’s guide for the home that provides all contact numbers and emergency numbers for the property. 

·  The applicant shall provide an exiting plan, to be posted throughout the residence. 

·  The applicant shall provide documentation which demonstrates that all windows and doors meet required egress standards. 

 

Commissioner Miller seconded the Motion.

Commissioners’ Choate, Johnson, Miller, Wallace and Chairman Jensen voted in favor of the Motion.

 

MOTION PASSED: 5-0

 

REPORT FROM STAFF: Carol Kuhn reminded the Planning Commission that next month the Planning Commission Hearing was moved up a week to November 14, 2018 and there is not a Work Session because of the holiday.

ADJOURNMENT:  There being no further business, the hearing adjourned at 7:14 p.m.

These minutes constitute the Resolution of the Larimer County Planning Commission for the recommendations contained herein which are hereby certified to the Larimer County Board of Commissioners.
