MINUTES OF THE LARIMER COUNTY BOARD OF ADJUSTMENT

(December 16, 2014)

 

            The regular meeting of the Larimer County Board of Adjustment was held in the County Board Hearing Room in the Larimer County Courthouse Offices, Fort Collins, Colorado at 7:00 p.m., December 16, 2014 at which time the following business was transacted. 

 

Board Members Present:         Alan Cram, Joseph Wise, Carol Dowding, Jeffrey Schneider, and Jason Wolfe

 

Staff Present:                          Karin Madson and Matt Lafferty, County Planners

 

Minutes:  Carol Dowding moved and Jason Wolfe seconded the Motion to approve the October 28, 2014 Minutes of the Larimer County Board of Adjustment as presented. Board members Alan Cram, Joseph Wise, Carol Dowding, Jeffrey Schneider, and Jason Wolfe voted in favor of the Motion.  The Minutes were unanimously approved.

 

Findings and Resolutions:  Carol Dowding moved and Joseph Wise seconded the Motion to approve the following Findings and Resolutions: Saldanha Setback Variance (#14-BOA1006) and Bricker Setback Variance (#14-BIA1004).  Board members Alan Cram, Joseph Wise, Carol Dowding, Jeffrey Schneider, and Jason Wolfe voted in favor of the Motion.

 

 

Applications:

 

A.        Consent Applications

 

The following application was approved by consent:

 

 

File No:                       #14-BOA0993  (Lyons 4th Modification Setback Variance)

Owners/Applicants:    Gail & Harley Lyons

 

Request: The Application of Gail and Harley Lyons, requesting a variance was presented to the Board.  The Application requested a setback variance modification to allow: a) the addition of an 8 x 12.8 foot triangle on the southwest end of deck, b) a 2-foot extension of the deck on the stream side and c) a 6 foot extension of the deck to access both existing 4 foot wide exterior stairs that access the crawl space as well as the front porch.  The new improvements will be located 11.3 feet from the road rather than the required minimum of 25 feet and located 25.4 feet from the stream rather than the required minimum of 100 feet in the FO-Forestry zone.

 

Action:  Carol Dowding moved and Jason Wolfe seconded the Motion to approve the Application with the following conditions:

           

1.    The conditions of approval associated with variance requests 12-BOA0920, 13-BOA0942 and 14-BOA0993 shall continue to apply, except as modified by this request.

 

2.    Failure to comply with any conditions of the Variance approval may result in reconsideration of the use and possible revocation of the approval by the Board of Adjustment.

 

3.    All future additions or buildings that would be within setbacks as defined in the Land Use Code must go through the proper county review and planning process prior to construction.

 

4.    After the applicant applies for a building permit but prior to foundation pour, the Larimer County Building Department must be provided with a written certification by a Colorado Licensed Land surveyor that the proposed structure is located where shown on the Larimer County approved Plot Plan for this Department.

 

5.    During the construction of the house, erosion control measures must be used to eliminate any silt or materials from entering the drainage way.  In addition, all disturbed areas must be properly re-vegetated as soon as practicable.

 

6.         This approval shall automatically expire one year from the date of this Resolution unless prior to expiration the Applicants (a) take affirmative action consistent with this approval, OR (b) submit a written request showing good cause to extend the one year time limit.

 

Board members Alan Cram, Joseph Wise, Carol Dowding, Jeffrey Schneider, and Jason Wolfe voted in favor of the Motion.  The Application was approved with conditions. 

 

B.        Discussion Applications

 

The following applications were ruled on after Board discussion:

 

File No:                       #14-BOA1008  (Andress Setback Variance)

Applicants/Owners:    Ray and Judith Andress

 

            A request to table the Andress Setback Variance was made.

 

            Jeffrey Schneider moved and Jason Wolfe seconded the motion that the Board table this matter to January 27, 2015 at 7:00 p.m.

 

            The question was called and members, Alan Cram, Joseph Wise, Carol Dowding, Jeffrey Schneider, and Jason Wolfe voted in favor of the motion.

 

File No:                       #14BOA1009  (Nagle Setback Variance)

Owners/Applicants:    Douglas & Denise Nagle

Request:   The Application of Douglas and Denise Nagle, requesting a variance was presented to the Board.  The Application requested a setback variance to allow a new garage to be located 65 feet from the centerline of County Road 3 rather than the required minimum of 100 feet from the centerline of the right-of-way in the FA-1 Farming zone.

 

Action:  Carol Dowding moved and Joseph Wise seconded the Motion to approve the Application.

           

Board Members Alan Cram, Joseph Wise, Carol Dowding, Jeffrey Schneider, and Jason Wolfe voted against the Motion.  The Application was denied for failure to receive the requisite four votes in favor.

 

Other Business

 

            County Planner Matt Lafferty asked the Board to reschedule an executive session to the January 2015 meeting.  The Board agreed by consensus.
