MINUTES OF THE LARIMER COUNTY BOARD OF ADJUSTMENT

(November 27, 2018)

 

The regular meeting of the Larimer County Board of Adjustment was held in the County Board Conference Room in the Larimer County Courthouse Offices, Fort Collins, Colorado at 6:00 p.m., November 27, 2018 at which time the following business was transacted.

 

Board Members Present: Carol Cochrane, Lee Taylor, Christine Pardee, Joseph Wise, and Jeffrey Schneider

 

Staff Present: Jenn Cram and Rebecca Westerfield, County Planners, and William G. Ressue, Deputy County Attorney

 

Minutes: Lee Taylor moved and Carol Cochrane seconded the Motion to approve the September 25, 2018 Minutes of the Larimer County Board of Adjustment as presented. There were no variance requests heard in October. Board members Carol Cochrane, Lee Taylor, Christine Pardee and Joseph Wise voted in favor of the Motion. The Minutes were unanimously approved.

Consent Application:

 

The following application was approved by consent:

 

File No: #18-ZONE2417 (KHBM Partners III LTD Setback Variance)

Owner: KHBM Partners III LTD

Applicant: Nathan Kinley

 

Request: The Application of Nathan Kinley, requesting a variance was presented to the Board. The Application requested a setback variance to allow a new residence and attached garage to be located 5 feet from the street/road setback rather than the required minimum of 25 feet in the O-Open zone.

 

Action: There were no requests from the public, the Board, or Staff to have a full hearing on this request and therefore it remained on the Consent Agenda. Lee Taylor moved and Carol Cochrane seconded the Motion to approve the Application with the following conditions:

 

1. Failure to comply with any conditions of the variance approval may result in reconsideration of the use and possible revocation of the approval by the Board of Adjustment.

 

2. This approval shall automatically expire one year from the date of this Resolution unless prior to expiration the applicant (a) takes affirmative action consistent with this approval, OR (b) submits a written request showing good cause to extend the one-year time limit.

 

3. All future additions or buildings that would be within setbacks as defined in the Land Use Code must go through the proper county review and planning process prior to construction.

 

4. The Larimer County Building Department must be provided with a written certification by a Colorado Licensed Land surveyor that the proposed residence and attached garage are located where shown on the Larimer County approved Plot Plan for this development.

 

Board members Carol Cochrane, Lee Taylor, Christine Pardee, Joseph Wise, and Jeffrey Schneider voted in favor of the Motion. The Application was approved with conditions.

 

Discussion Application:

 

The following applications were approved after discussion:

 

File No: #18-ZONE2432 (Baker Setback Variance)

Owners/Applicants: JoAnn and Norman Baker

 

Request: The Application of JoAnn and Norman Baker, requesting a variance was presented to the Board. The Application requested a setback variance to allow an existing garage addition to be located 10 feet from the street/road rather than the required minimum of 20 feet and to allow an existing above ground pool and deck to be located 1.1 feet from the north property line and 1.9 feet from the west property line, rather than the required minimum of 5 feet in the R1 Residential zone.

 

Action: The request was removed from the consent agenda for a full proceeding. Jeffrey Schneider moved and Christine Pardee seconded the Motion to approve the Application with the following conditions:

1. Failure to comply with any conditions of the variance approval may result in reconsideration of the use and possible revocation of the approval by the Board of Adjustment.

Tabled item:

Owners/Applicants: Frank & Lori Stetson

 

After discussion, a request to table the Stetson Setback Variance was made by the Applicants.

Carol Cochrane moved and Lee Taylor seconded the motion that the Board table this matter to December 18, 2018 at 6:00 p.m.

 

The question was called and members Carol Cochrane, Lee Taylor, Christine Pardee, Joseph Wise, and Jeffrey Schneider voted in favor of the motion.

 

Adjournment: The meeting was adjourned at 6:45 p.m.
