MINUTES OF THE LARIMER COUNTY BOARD OF ADJUSTMENT

(September 23, 2014)

 

            The regular meeting of the Larimer County Board of Adjustment was held in the County Board Hearing Room in the Larimer County Courthouse Offices, Fort Collins, Colorado at 7:00 p.m., September 23, 2014 at which time the following business was transacted. 

 

Board Members Present:         Jason Wolfe, Carol Dowding, Alan Cram, Jeffrey Schneider, and Jim Pisula           

 

Staff Present:                          Michael Whitley and Karin Madson, County Planners, and William G. Ressue, Deputy County Attorney       

 

Minutes:  Jim Pisula moved and Jason Wolfe seconded the Motion to approve the August 26, 2014 Minutes of the Larimer County Board of Adjustment as presented. Board members Jason Wolfe, Carol Dowding, Alan Cram, Jeffrey Schneider, and Jim Pisula voted in favor of the Motion.  The Minutes were unanimously approved.

 

Findings and Resolutions:  Carol Dowding moved and Jim Pisula seconded the Motion to approve the following Findings and Resolutions: Cuckler Setback Variance (#14-BOA0996) and Rollerland Setback Variance (#14-BOA0998). Board members Jason Wolfe, Carol Dowding, Alan Cram, Jeffrey Schneider, and Jim Pisula voted in favor of the Motion.

 

 

Applications:

 

A.        Consent Applications

 

The following applications were approved by consent:

 

File No:           # 14-BOA1000  (Big Elk Meadows Setback Variance)

Owner:            Big Elk Meadows Homeowners Association

Applicant:       Leonard Arnold & Teri Oates

 

Request: The Application of Leonard Arnold & Teri Oates, requesting a variance was presented to the Board.  The Application requested a setback variance to allow the expansion of an existing office building/gatehouse that would be located 0 feet from a street rather than the required minimum of 25 feet and to be located 67 feet from the centerline of a waterway rather than the required minimum of 100 feet in the O-Open zone.

 

Action:  Carol Dowding moved and Jeffrey Schneider seconded the Motion to approve the Application with the following conditions:

           

 

1.         Failure to comply with any conditions of the variance approval may result in reconsideration of the use and possible revocation of the approval by the Board of Adjustment.

 

2.         This approval shall automatically expire one year from the date of this Resolution unless prior to expiration the Applicants (a) take affirmative action consistent with this approval, OR (b) submit a written request showing good cause to extend the one year time limit.

 

3.         All future additions or buildings that would be within setbacks as defined in the Land Use Code must go through the proper County review and planning process prior to construction.

 

4.         After the applicant applies for a building permit but prior to foundation pour, the Larimer County Building Department must be provided with a written certification by a Colorado Licensed Land surveyor that the proposed structure is located where shown on the Larimer County approved Plot Plan for this development.

 

Board members Jason Wolfe, Carol Dowding, Alan Cram, Jeffrey Schneider, and Jim Pisula voted in favor of the Motion.  The Application was approved with conditions. 

 

 

File No:           #14-BOA1002  (Van Cleave Setback Variance)

Owners:           Jason and Jennifer Van Cleave

Applicants:      Alan Strope / Savant Homes, Inc.

 

Request:   The Application of Alan Strope with Savant Homes, Inc., requesting a variance was presented to the Board.  The Application requested a setback variance to allow a new addition to an existing residence that is non-conforming.  The existing house is 72 feet from the centerline of the road (major collector) and the required minimum setback is 100 feet from the centerline in the O-Open zone.

           

Action:  Carol Dowding moved and Jeffrey Schneider seconded the Motion to approve the Application with the following conditions:

           

1.         Failure to comply with any conditions of the variance approval may result in reconsideration of the use and possible revocation of the approval by the Board of Adjustment.

 

2.         This approval shall automatically expire one year from the date of this Resolution unless prior to expiration the Applicants (a) take affirmative action consistent with this approval, OR (b) submit a written request showing good cause to extend the one year time limit.

 

3.         All future additions or buildings that would be within setbacks as defined in the Land Use Code must go through the proper County review and planning process prior to construction.  This may include additional variance requests for the above mentioned structures that do not have building permits or inspection approvals.

 

4.         After the Applicants apply for a building permit but prior to foundation pour, the Larimer County Building Department must be provided with a written certification by a Colorado Licensed Land surveyor that the proposed structure is located where shown on the Larimer County approved Plot Plan for this Department.

 

Board members Jason Wolfe, Carol Dowding, Alan Cram, Jeffrey Schneider, and Jim Pisula voted in favor of the Motion.  The Application was approved with conditions. 

 

File No:                                   #14-BOA0999  (Branch Setback Variance)

Owners/Applicants:                Louis & Sandra Branch

 

Request:   The Application of Louis and Sandra Branch, requesting a variance was presented to the Board.  The Application requested a setback variance to allow a proposed garage to be located 15 feet from the side lot line rather than the required minimum of 25 feet in the E-1 Estate zone.

           

Action:  Carol Dowding moved and Jeffrey Schneider seconded the Motion to approve the Application with the following conditions:

           

1.         Failure to comply with any conditions of the variance approval may result in reconsideration of the use and possible revocation of the approval by the Board of Adjustment.

 

2.         This approval shall automatically expire one year from the date of this Resolution unless prior to expiration the Applicants (a) take affirmative action consistent with this approval, OR (b) submit a written request showing good cause to extend the one year time limit.

 

3.         All future additions or buildings that would be within setbacks as defined in the Land Use Code must go through the proper County review and planning process prior to construction.  This may include additional variance requests for the above mentioned structures that do not have building permits or inspection approvals.

Board member Jim Pisula moved and Jeffrey Schneider seconded the motion to appoint Alan Cram as Chair of the Board.  Board members Jason Wolfe, Carol Dowding, Alan Cram, Jeffrey Schneider, and Jim Pisula voted in favor of the Motion.
