MINUTES OF THE LARIMER COUNTY BOARD OF ADJUSTMENT

(June 28, 2016)

 

            The regular meeting of the Larimer County Board of Adjustment was held in the County Board Hearing Room in the Larimer County Courthouse Offices, Fort Collins, Colorado at 6:00 p.m., June 29, 2016 at which time the following business was transacted. 

 

Board Members Present:         Joseph Wise, Jim Pisula, Carol Dowding, Jeffrey Schneider, Tom Peterson

 

Staff Present:                          Savanah Benedick and Rebecca Smith, County Planners, and William G. Ressue, Deputy County Attorney     

 

Minutes:  Jim Pisula moved and Tom Peterson seconded the Motion to approve the May 24, 2016 Minutes of the Larimer County Board of Adjustment as presented. Board members Joseph Wise, Jim Pisula, Carol Dowding, Jeffrey Schneider, and Tom Peterson voted in favor of the Motion.  The Minutes were unanimously approved.

 

Findings and Resolutions:  Jeffrey Schneider moved and Tom Peterson seconded the Motion to approve the following Findings and Resolution: Broomfield Setback Variance (#16-BOA1070) Board members Joseph Wise, Jim Pisula, Carol Dowding, Jeffrey Schneider, and Tom Peterson voted in favor of the Motion.

 

Consent Applications:

 

The following applications were approved by consent:

 

File No:           #16-BOA1079  (Gabucci/Morgan Setback Variance)

Owner:                        Jason Gabucci

Applicants:      Jason Gabucci & Lisa Morgan

 

Request: The Application of Jason Gabucci & Lisa Morgan, requesting a variance was presented to the Board.  The Application requested a setback variance to allow a new accessory building to be located 16’ from the edge of the Highway 34 right-of-way and 50’ from the centerline of the right-of-way rather than the required minimum of 100’ feet in the O-Open zone.

 

Action:  Joseph Wise moved and Jeffrey Schneider seconded the Motion to approve the Application with the following conditions:

           

1.         Failure to comply with any conditions of the Variance approval may result in reconsideration of the use and possible revocation of the approval by the Board of Adjustment.

 

2.         All future additions or buildings that would be within setbacks as defined in the Land Use Code must go through the proper county review and planning process prior to construction.

 

3.         This approval shall automatically expire in one year unless the applicant takes affirmative action consistent with this approval.

 

4.         After the applicant applies for a building permit but prior to foundation pour, the Larimer County Building Department must be provided with a written certification by a Colorado Licensed Land surveyor that the proposed structure is located where shown on the Larimer County approved Plot Plan for this development.

 

Board members Joseph Wise, Jim Pisula, Carol Dowding, Jeffrey Schneider, and Tom Peterson voted in favor of the Motion.  The Application was approved with conditions. 

 

Discussion Applications:

 

The following applications were approved after discussion:

 

File No:                       #16-BOA1078  (McDonough Setback Variance)

Owner/Applicant:       Maureen P. McDonough

 

Request: The Application of Maureen P. McDonough, requesting two variances was presented to the Board.  The Application requested a setback variance to allow two as-built loafing sheds to be located within the required setback. One to be located 5’3” from the rear property line rather than the required minimum of 10’, and to allow the other shed to be located 4’2” from the east property line rather than the required minimum of 5’in the FA-1 Farming zone.

 

Action:  Jeffrey Schneider moved and Joseph Wise seconded the Motion to approve the Application with the following conditions:

           

1.    Failure to comply with any conditions of the Variance approval may result in reconsideration of the use and possible revocation of the approval by the Board of Adjustment.

 

2.    All future additions or buildings that would be within setbacks as defined in the Land Use Code must go through the proper county review and planning process prior to construction.

 

3.    This approval shall automatically expire in one year unless the applicant takes affirmative action consistent with this approval.

File No:                       #16-BOA1075  (ABC/Firehouse Self-Storage Setback Variance)

Owners/Applicants:    BTDJ LLC / R. Don Burton

 

Request: The application requested a setback variance to allow self-storage units to be built/located on the property line of I1-Industrial zoned property rather than the required minimum 10 feet from a side yard and 25 feet from a roadway

Action:  Jeffrey Schneider moved and Joseph Wise seconded the Motion to approve the Application with the following conditions:

           

1.         Failure to comply with any conditions of the variance approval may result in reconsideration of the use and possible revocation of the approval by the Board of Adjustment.

 

2.         This approval shall automatically expire one year from the date of this Resolution unless prior to expiration the Applicant (a) takes affirmative action consistent with this approval, OR (b) submits a written request showing good cause to extend the one year time limit.

 

3.         All future additions or buildings that would be within setbacks as defined in the Land Use Code must go through the proper county review and planning process prior to construction.

 

4.         The applicant shall complete the Site Plan Review prior to submitting for a building permit.

 

5.         The applicants shall obtain a Development Construction Permit from the Engineering Department, if it determined to be required during the Site Plan Review process.

 

Board members Joseph Wise, Jim Pisula, Carol Dowding, Jeffrey Schneider, and Tom Peterson voted in favor of the Motion.  The Application was approved with conditions.
