MINUTES OF THE LARIMER COUNTY BOARD OF ADJUSTMENT

(March 22, 2016)

 

            The regular meeting of the Larimer County Board of Adjustment was held in the County Board Hearing Room in the Larimer County Courthouse Offices, Fort Collins, Colorado at 6:00 p.m., March 22, 2016 at which time the following business was transacted. 

 

Board Members Present:         Joseph Wise, Carol Dowding, Jim Pisula, Jeffrey Schneider, and Tom Peterson

 

Staff Present:                          Karin Madson, Savanah Benedick, Rebecca Smith, County Planner(s), and William G. Ressue, Deputy County Attorney           

 

Minutes:  Jim Pisula moved and Jeffrey Schneider seconded the Motion to approve the February 23, 2016 Minutes of the Larimer County Board of Adjustment as presented. Board members Joseph Wise, Carol Dowding, Jim Pisula, Jeffrey Schneider, and Tom Peterson voted in favor of the Motion.  The Minutes were unanimously approved.

 

Findings and Resolutions:  Jeffrey Schneider moved and Tom Peterson seconded the Motion to approve the following Findings and Resolutions: Kerig Setback Variance (#16 BOA1059) and Rowe Setback Variance (#16 BOA1038) Board members Joseph Wise, Carol Dowding, Jim Pisula, Jeffrey Schneider and Tom Peterson voted in favor of the Motion.

 

Tabled Applications:

 

File No:           #16-BOA1061  (Gonzales-Medina Setback Variance)

 

            A request to table the Gonzales-Medina Setback Variance to March 22, 2016 was made and consented to by the applicant.

 

            The request was granted by consensus of the Board members.

Regular Agenda:

 

The following application was heard on the regular agenda:

 

File No:           #15 BOZ1057  (Hardle Setback Variance)

Owner(s):        Trevace & Stephanie Hardle

Applicant(s):   Travace & Stephanie Hardle

 

Request: The Application of Trevace and Stephanie Hardle, requesting a variance was presented to the Board.  The Application requested a setback variance to allow an as-built outbuilding to be 16 feet from the property line rather than the required 25 feet per section 4.1.5.B.3.b of the Larimer County Land Use Code.

 

Action:  Joseph Wise moved and Jim Pisula seconded the Motion to approve the Application.  Board members Joseph Wise, Carol Dowding, and Jim Pisula voted in favor of the Motion; Board members Jeffrey Schneider and Tom Peterson voted against the Motion.  The Application was denied for failure to obtain the required four votes in favor. 

 

Other Business:

 

            A request was made to go into executive session for conference with the County Attorney’s office pursuant to C.R.S 24-6-402 (4)(b) for the purpose of receiving legal advice on variance review criteria and weight of evidence. 

 

            The question was called and members Joseph Wise, Carol Dowding, Jim Pisula, Jeffrey Schneider, and Tom Peterson voted in favor of the motion.  The Board entered executive session.

 

Adjournment:  The meeting was adjourned at 7:03 p.m.
